The agreement
These terms are an agreement between you and Institra Private Limited, a company incorporated in India with its office in Bengaluru, Karnataka (“Institra”, “we”, “us”). They govern your use of Institra: the web app at app.institra.in, the Institra Desktop exam client, and this website (together, the “Service”). By creating an account or using the Service you agree to them.
If your institute has a written agreement with Institra, that agreement governs the institute’s use of the Service and prevails over these terms wherever the two differ. These terms then apply to you as a person using the Service under it.
Accounts
- Students join through an invitation from their institute or a course; they cannot create accounts on their own.
- Professors, counsellors and staff join through an invitation from their institute, or a professor may create an individual account.
- An institute account is created by a person authorised to act for that institute, who becomes its first administrator.
You must give accurate details and keep your sign-in secure. You are responsible for what is done with your account. Tell your institute and us at once if you believe your account has been used without your permission. Signing in with Google or Microsoft is subject to that provider’s own terms.
Acceptable use
Use the Service only for teaching, learning, assessment and the wellbeing programme your institute runs. In particular, do not:
- attempt to defeat, disable or evade proctoring or the desktop client’s lockdown, or help anyone else to;
- impersonate another person, or take an exam or complete work on someone else’s behalf;
- access data you are not entitled to see, or probe the Service for weaknesses without our written permission;
- copy, redistribute or publish exam questions, answer keys or other material your institute has not made public;
- reverse-engineer, decompile or modify the desktop client, or interfere with the attestation it sends;
- upload anything unlawful, harmful or infringing, or use the Service to harass anyone;
- scrape the Service or place an unreasonable load on it.
Your institute’s academic-integrity and conduct rules also apply. Breaches of those rules are for the institute to judge; breaches of these terms may lead us to suspend or close an account.
Proctoring and the desktop client
Proctoring produces signals for a human to review. Institra never decides on its own that a student has cheated; the decision belongs to the professor and the institute’s processes. Signals can be wrong — a poorly lit room, a family member walking past — and the review exists for that reason.
Institra Desktop locks a computer to the exam as far as the operating system allows, and reports exactly what it could enforce. Windows can be locked down almost completely; macOS and Ubuntu’s default Wayland desktop do not allow any application to fully block screenshots or app switching, and the client says so rather than claim otherwise. You install and run the desktop client at your own choice; it makes no changes to your computer beyond the exam session.
AI features
Some features use AI models to generate questions, draft rubrics and suggest grades. AI output can be wrong. Every grade an AI suggests is a suggestion the professor confirms or changes; the professor remains responsible for the grade. You should review AI-generated questions and rubrics before using them.
Wellbeing module
The wellbeing module offers a check-in, standard screeners and a way to reach your institute’s counselling team. It is not a medical service, a diagnosis or emergency support, and the screeners produce indicative scores, not clinical assessments. Counselling is provided by your institute’s own staff under the institute’s policies. If you are in immediate danger, contact local emergency services; in India, Tele-MANAS at 14416 is free and available around the clock.
Your content and ours
Course material, questions, submissions, recordings and wellbeing records belong to the people and institutes who create them. You give Institra the permission it needs to store, process and display that content in order to run the Service, and for nothing else. Institra does not use your content to train AI models.
The Service itself — its software, design, name and logo — belongs to Institra Private Limited. You may use it as these terms allow and not otherwise.
Privacy
How we handle personal data is set out in our Privacy Policy, which forms part of these terms.
Fees and pilots
Institute pricing, pilots and payment terms are set in the institute’s agreement with us. A pilot can start without payment. Individual professor accounts on a free plan are provided as they are, and we may change what a free plan includes with reasonable notice.
Availability and changes
We work to keep the Service available, especially on exam days, and we tell institutes in advance about planned maintenance. Unless an institute agreement says otherwise, we do not promise a specific level of uptime. We may add, change or remove features; if a change removes something an institute depends on, we give notice.
Suspension and termination
You may stop using the Service at any time; an institute may end its agreement as that agreement provides. We may suspend or close an account that breaches these terms, or where needed to protect the Service or other users, and we will say why unless the law prevents it. When an institute’s agreement ends, we return or delete its data at the institute’s written instruction, subject to the retention rules in the Privacy Policy.
Liability
The Service is provided as it is. To the extent the law allows, Institra is not liable for indirect or consequential loss, for loss of data caused by events outside our reasonable control, or for decisions an institute takes on the basis of proctoring signals or AI suggestions. Nothing in these terms limits liability that cannot be limited under Indian law. Where an institute agreement sets a liability cap, that cap applies.
Governing law
These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka, unless an institute agreement provides otherwise.
Changes to these terms
When we change these terms we update the date at the top. For changes that matter, we tell institutes in advance. Continuing to use the Service after a change means you accept it.
